Q: Can a tenants rent be subsided from the bond if rent is in arrears?
A: A landlord cannot touch the bond without the tenants consent or an order from VCAT
Q: If a tenant opts to renew the lease can a landlord say no?
A: If a Tenant has been granted an option to renew the Lease a landlord must do so if they exercise this option. However, the renew option has to be accepted within the correct time period.
Q: Goods were left by the tenant upon vacating the premises. Can they be sold by the landlord?
A: The landlord must notify the tenant of the goods that were left behind and the consequences if they are not retrieved. The landlord must also give the tenant adequate time to respond and retrieve the goods. Should the tenant not respond or pick up the goods the landlord may sell them by public auction and keep the funds.
